I’m sorry to hear about your student visa refusal. Since your wife’s Subclass 500 application was refused, and you are currently on a Bridging Visa A (BVA), you can apply for work rights in some cases.
Here’s what I think you need to know based on my research
1. Appeal to the AAT – If you decide to appeal the decision, your current BVA remains valid until the AAT makes a determination.
2. Work Rights on BVA – By default, a Bridging Visa A granted with a student visa application typically does not allow work. However, you may be able to apply for work rights by submitting a separate application for a new Bridging Visa A with work rights (Form 1005).
3. Criteria for Work Rights – To be eligible, you must demonstrate financial hardship—meaning you cannot support yourself or your family without working.
4. Processing Time & Next Steps – The Department of Home Affairs assesses work rights applications on a case-by-case basis. If approved, you will receive a new BVA with permission to work.
5. Alternative Visa Options – While waiting for the AAT decision, you could explore other visa pathways, such as employer-sponsored visas, if you find a job where the employer is willing to sponsor you.
This is a pretty complex set of circumstances and I recommend discussing this with a migration agent to ensure your application for work rights has the best chance of approval.

Applying for a Student Visa (Subclass 500) as a Dependent Spouse
Once you are legally married, your partner can apply for a student visa as your dependent while onshore in Australia.
However, you must demonstrate a genuine and ongoing relationship, meaning marriage alone is not enough. Evidence such as joint financial commitments, shared living arrangements, and a history of the relationship will strengthen the application.
There is no official minimum marriage duration required, but a longer and well-documented relationship can help establish its authenticity.
Challenges to Consider
If your partner is applying as a dependent spouse, she will need to show that she meets the financial requirements.
You must prove that your relationship is genuine and continuing, which may involve providing documents like joint bank statements, lease agreements, and photos.
If her current student visa conditions include ‘No Further Stay’ (Condition 8534 or 8503), she may not be able to apply for a dependent visa onshore and would have to lodge from offshore.
Pathway to the Skilled Regional Visa (Subclass 491)
After completing the Diploma of Nursing, she may qualify as an Enrolled Nurse (ANZSCO 411411), which is on the Regional Occupation List (ROL), making her eligible for the 491 visa.
This is a viable pathway, but it will require state or territory nomination, and each region has different requirements for nomination.
As her dependent on a 491 visa, you do not necessarily need to be on the Skilled Occupation List, nor do you need a skills assessment. However, if you have skills in a high-demand occupation, it may improve your PR prospects in the long run.
Alternative Option: Pursuing Separate Student Visas
If you both pursue separate student visas, you will have independent options for post-study migration.
A Diploma of Community Health Services could lead to pathways in social work, aged care, or community services, which are in demand.
However, maintaining two student visas will mean higher tuition costs and financial proof requirements.
Recommendation
If your partner’s main goal is to obtain PR as an Enrolled Nurse, applying as a dependent spouse on your student visa is a reasonable option. The 491 visa pathway is feasible, provided she secures state nomination.
If you want flexibility for both of you in the future, pursuing separate student visas might provide more opportunities.

- Find a suitable job via one of the job sites I mentioned previously.
- Apply for the role (Send your resume).
- Have an interview (by telephone or video call)
- Receive a job offer.
- Submit your visa application.
Although this is a very simple breakdown, it’s aligned with the main steps of the process.
The biggest challenge for some will be step 1 which is where we try to help with 482jobs though bricklayer roles are a little thin on the ground currently so we’d encourage you to also check the other sites we shared to broaden your search.
